  1. Nature and applicability of terms

Please read these terms and conditions (“Terms”) and the privacy policy carefully before you choose to use the website or use any of the services Medisquare offers. In connection with your access to the Website and use of the Services, these Terms and the Privacy Policy together form a binding contract between you and Medisquare.

You are subject to the Agreement regardless of whether you are:

  1. Any medical practitioner, healthcare organization, or similar institution that wants to be listed on the website or is currently listed there, including designated, authorized associates of such practitioners or institutions (“Practitioner(s)”, “you” or “User”); or
  2. A patient, his/her agents, or connections using the website to find practitioners (“End-User”, “you” or “User”)
  3. Alternatively, a website user(“you” or “User”)

The following services (“Services”), which are made available by Medisquare on the Website and are provided without charge to Users, are covered by this Agreement:

  1. For Practitioners: To be made available to other Users and Website visitors is a list of Practitioners, together with their profiles and contact information.
  2. For other Users: The ability to set up and manage “Health Accounts,” (ii) look for Practitioners by name, speciality, location, or any other criteria that Medisquare may establish and make available, and (iii) schedule appointments with Practitioners.

The Agreement will apply to your visit to and use of the Website to access the Service, as well as to all information provided by you on the Website at any given time. The Services may vary from time to time at Medisquare’s sole discretion.

This Agreement outlines the rules and restrictions that apply to your use of the Website as well as how we will handle your account while you are a registered user with us. Feel free to get in touch with us if you have any questions about the Agreement in general.

You hereby unconditionally accept and agree to be bound by the terms and conditions set out in this Agreement, the Subscription Terms of Service, and the Privacy Policy, as made accessible on the Website, by downloading or otherwise accessing the Website to use the Services. All prior oral and written terms and conditions (if any) relating to your use of the Website to access the Services have been superseded by the terms and conditions contained in this Agreement. You acknowledge that you have read and agree to the terms of this Agreement by using any Service.

Any changes will be communicated to you in writing, and we reserve the right to change or terminate any part of the Agreement at any time and for any reason. The Agreement should be read by you on a frequent basis. You agree to follow and be bound by the Agreement as modified if you continue to use the Website after any such changes.

You acknowledge that by using any of the Services we provide, you will be subject to the terms of this Agreement. Please refrain from using the Website or using any Services if you do not agree with any aspect of the Agreement.

Your use of the Website and the Services is entirely up to Medisquare’s discretion.

  1. Conditions of use

For Practitioners: You are a BMDC registered doctor and a legal citizen of Bangladesh or legally living in Bangladesh. You hereby represent and warrant that you are qualified to provide medical services in Bangladesh; that you have obtained all licenses required by law to provide medical services and that you have not committed any act or omission that could endanger their extension or renewal; and that you have provided Medisquare with true, accurate, complete, and up-to-date information about your qualifications and experience.

For other Users: You are a legal citizen of Bangladesh or legally living in Bangladesh. You are 18 years of age or above, as defined by Bangladeshi law, or you are using all Medisquare services with the full approval and supervision of a fully grown member of your family. Or you’re utilizing this service for a family member who is completely aware of the situation. You are the legal guardian of the person if he or she is a minor.

  1. Terms of use applicable to all other users other than practitioners

3.1 You confirm that all the information you provided for registering as a patient is correct(Full name, active mobile number, gender, email address)

3.2 While using the services of Medisquare you will refrain from using the service in any action that is against the state and public, and does any harm to the state. Apart from this, you will refrain from any act which may insult or discriminate against any religion, race or personal affairs of any person through this service.

3.3 Your personal information will be used in a secure manner by Medisquare. To protect you from unwanted access, Medisquare has deployed a variety of encryption and security technologies, as well as some procedures. You are solely responsible for how your username and password are used. When there is a violation of the code, Medisquare maintains the right to revoke or delete your account and password at any time.

3.4 Where the user has expressly or implicitly consented to Medisquare making disclosures or publications, Medisquare shall not be responsible or liable in any way to the users for any losses, damage, injuries, or expenses incurred by the users as a result of any disclosures or publications made by Medisquare.

3.5 Medisquare maintains the right to share user information with a third party with the user’s prior explicit and informed consent.

3.6 Medisquare will remove information in accordance with applicable law and will not be held liable or responsible for critical content submitted by users. 

3.7 If Medisquare determines that you have provided false information or enabled fraudulent feedback, Medisquare reserves the right to suspend any of your Medisquare accounts immediately and to make such a declaration on the website alongside your name as Medisquare deems appropriate for the protection of its business and the interests of users.

3.8 You agree not to post or publish any content that is defamatory, obscene, objectionable, or in nature, and Medisquare reserves the right to remove any remarks that it determines, in its sole discretion, to be in violation of these terms and conditions or any applicable law at the time.

3.9 The right to show sponsored advertisements on the website is reserved by Medisquare. Medisquare will not be liable for the accuracy of information or claims made in the advertisements, regardless of the status of other content. Medisquare does not recommend that users visit these advertisements or use their services.  You represent and warrant that you will use these services in a legal and ethical manner. Any violation of applicable law resulting from your use of these services is solely your responsibility, with Medisquare assuming no liability.

3.10 In the case of inquiry or sharing data with any government agency or security body, the authority of Medisquare is bound to submit. 

3.11 Users are also forbidden from attempting or violating the website’s or any Medisquare content’s security or integrity.

3.12 Appointment times are subject to the availability of the doctor; in the event of a cancellation, the appointment will be rescheduled for the next available time

3.13 Before receiving the service, the user can verify the doctor’s entire personal information. Medisquare, on the other hand, verifies the information of service providers (doctors) on its own and only enables them to give services in Medisquare after doing so. However, if the service recipient wants, he can check the service provider’s (doctor’s) BMDC ID. Medisquare will not be held liable if an issue arises after the service recipient has verified the information.

3.14 Because Medisquare connects the service recipient and the service provider, there is no direct relationship between Medisquare and the service provider, and Medisquare will not be held liable if there is a problem with the service delivery. However, if the service recipient alerts Medisquare support of any problems with the service, action will be taken against the service provider based on a valid proof window.

3.15 Users must pay the consultation fee and VAT before joining the doctor’s queue for consultation if there is one.

3.16 The consultation fee is set by each doctor separately and Medisquare is not responsible for setting the individual fees of doctors

3.17 Users will not be required to pay a consultation fee if there is none, and they will be routed immediately to the doctor’s consultation queue.

3.18 Except as indicated herein, the Patient will not be allowed to cancel the payment once it has been made and they have joined the queue.

3.19 Users can cancel a consultation if the wait time in line exceeds 60 minutes, and a refund will be issued after a processing fee of 5% is deducted.

3.20 Users can seek a rescheduling of their appointment, but they must do so at least three hours prior to the planned time. There will be no additional charges as a result of this.

3.21 If the rescheduling is done within 3 hours prior to the planned time you will be charged a processing fee of 5%.

3.22 You will be fully refunded in the case you are not given any treatment or advice. 

3.23 The refund process could take up to 7 days.

3.24 You are requested to pay fees through the payment methods of Medisquare. Medisquare authority will not be held accountable for any problem arising from accepting through other methods.

3.25 Any unethical transaction through Medisquare will not be accepted and Medisquare authority will not be held liable for it.

3.26 Medisquare shall not be accountable for any problems arising from technological glitches that are not easily resolved, as Medisquare is technology based and the technology has various limitations and flaws.

3.27 Since the platform of Medisquare is dependent on the use of the internet,  Medisquare authority will not be held responsible if the service is disrupted due to any internet-related problem.

3.28 Because Medisquare services are delivered over the internet, mobile devices, and computers, the Medisquare authority will not be held liable if any service is disrupted as a result of a device malfunction.Because Medisquare services are delivered over the internet, mobile devices, and computers, the Medisquare authority will not be held liable if any service is disrupted as a result of a device malfunction.

3.29 Because Medisquare services rely on the internet and devices, you may receive services before or beyond the prescribed time owing to device charges or internet issues, which should be interpreted as a system delay.

3.30 If you apply the advice from a registered doctor of Medisquare to another person and if there is any problem arising from it, Medisquare will not be held liable. 

3.31 Users can use Medisquare’s services to consult a registered doctor, but Medisquare will not be liable for any medical problems, mutilation, or death as a result of that consultation.

3.32 You understand, acknowledge, and agree that the Doctor may ask you to provide relevant information (complaints, information about any previous consultations for the same problem, available investigation and medication details, if any), and that you will ensure that the information you provide to the doctor is accurate.

  1. Terms of use for practitioners

4.1 While using the services of Medisquare you will refrain from using the service in any action that is against the state and public, and does any harm to the state. Apart from this, you will refrain from any act which may insult or discriminate against any religion, race or personal affairs of any person through this service.

4.2 Medisquare gathers and publishes information about the doctors’ profiles, contact information, and practice on the website, both directly and indirectly. Any information  about you or your profile that is shown on the Website is found to be incorrect, you must notify Medisquare promptly so that Medisquare can correct it. Upon your request Medisquare may remove any information from your doctor’s profile, however Medisquare is under no obligation to remove publicly available personal details. Medisquare makes the decision whether to publish or refuse requests for revisions or updates on its own.

4.3 Doctors must renew their medical licenses as soon as possible and inform Medisquare.

4.4 Your personal information will be used in a secure manner by Medisquare. Medisquare does not recommend that users visit these advertisements or use their services.  You represent and warrant that you will use these services in a legal and ethical manner. Any violation of applicable law resulting from your use of these services is solely your responsibility, with Medisquare assuming no liability.

4.11 You will not seek personal and medical records of patients without their permission.

4.12 Doctor vows to keep all information submitted by a user to him/her in the strictest secrecy at all times. Doctor undertakes that he or she will not reveal any information or documentation submitted by a User to any other person, nor will he or she allow such information or documentation to be obtained by any other person, whether by act or omission.  

4.13 In the case of inquiry or sharing data with any government agency or security body, the authority of Medisquare is bound to submit. 

4.14 Users are also forbidden from attempting or violating the website’s or any Medisquare content’s security or integrity.

4.15 You can enjoy the benefits of Medisquare services for a month after the registration. After the initial trial period you have to pay a monthly subscription charge or an annual subscription charge as per the plan you select. 

4.16 After completing the registration process and payment, you may begin enjoying the benefits of Medisquare subscription. You can terminate your subscription on the Medisquare website/App at any moment. Your subscription benefits are non-transferable and are intended solely for your personal use. Medisquare reserves the right to cancel your subscription at any time. 

4.17 In the case you want to cancel your subscription after payment: if the cancellation is within 5 days you will be fully refunded. If the cancellation is within 5-10 days you will be refunded 85% of your subscription fee. However, no refunds will be provided after 10 days. You will be refunded by Medisquare in 5 business days. 

4.18 You can set your chamber fee according to your will. However doctors cannot by any means charge extra money from the patients than the fee set by him or her.

4.19 You are requested to accept fees from the patients through the payment methods of Medisquare. Medisquare authority will not be held accountable for any problem arising from accepting through other methods.

4.20 Any unethical transaction through Medisquare will not be accepted and Medisquare authority will not be held liable for it.

4.21 In the case you take fees from a patient without giving treatment or advice, the patient will be fully refunded. 

4.22 Medisquare maintains the right to regulate doctors’ feedback recommendations and to remove any abusive, improper, or promotional content posted on the website.

4.23 Medisquare shall not be accountable for any problems arising from technological glitches that are not easily resolved, as Medisquare is technology based and the technology has various limitations and flaws.

4.24 Since the platform of Medisquare is dependent on the use of the internet,  Medisquare authority will not be held responsible if the service is disrupted due to any internet-related problem.

4.25 Because Medisquare services are delivered over the internet, mobile devices, and computers, the Medisquare authority will not be held liable if any service is disrupted as a result of a device malfunction.Because Medisquare services are delivered over the internet, mobile devices, and computers, the Medisquare authority will not be held liable if any service is disrupted as a result of a device malfunction.

4.26 Because Medisquare services rely on the internet and devices, you may give services before or beyond the prescribed time owing to device charges or internet issues, which should be interpreted as a system delay for the patient. 

4.27 If patients apply the advice from a registered doctor of Medisquare to another person and if there is any problem arising from it, Medisquare will not be held liable. 

4.28 Because Medisquare connects the service recipient and the service provider, there is no direct relationship between Medisquare and the service provider, and Medisquare will not be held liable if there is a problem with the service delivery. However, if the service recipient alerts Medisquare support of any problems with the service, action will be taken against the service provider based on valid proof.

  1. Rights and obligations relating to content 

By means of this notice, Medisquare makes Users aware that they are not allowed to host, display, upload, change, publish, transmit, update, or share any data that:

  1. belonging to a third party and over which the User has no authority
  2. is extremely damaging, harassing, blasphemous, defamatory, obscene, pornographic, pedophilic, libelous, invading another person’s privacy, objectionable due to race or ethnicity, insulting, relating to or supporting money laundering or gambling, or otherwise illegal in any way;
  3. hurt children in any form;
  4. violates any intellectual property rights (patents, trademarks, copyrights, etc.);
  5. violates any already applicable law;
  6. misleading the addressee about the source of the messages or sending any information that is blatantly insulting or ominous in character;
  7. mimic someone else;
  8. contains computer code, files, or programs that have the ability to interrupt, delete, or restrict the use of any computer resource;
  9. threatens Bangladesh’’s unity, integrity, defense, security, or sovereignty, cordial relations with other countries, or public order, or encourages the commission of any crime that is punishable by law, obstructs the investigation of any crime, or disparages any other country.
  10. compromising the security or integrity of the website or any Medisquare content, or attempting to do so;
  11. conveying any information on or through the website that is disruptive to or competitive with Medisquare’’s provision of services, including job postings, communications, and hyperlinks;
  12. purposefully posting any incomplete, incorrect, or erroneous information on the website;
  13. sending other Users any unsolicited communications;
  14. utilizing any navigation or search technology (including but not limited to spiders, robots, avatars, or intelligent agents) to access, browse, or search the Website;
  15. attempting to reverse-engineer, interpret, decompile, or disassemble any element of the website;
  16. any Medisquare Content or other information available from the website being copied or duplicated in any way;
  17. hot linking, deep linking, or framing any Medisquare content
  18. evading or disabling any software’s usage restrictions, digital rights management, or other security measures.
  1. Terminations

6.1 In addition to exercising any other legal remedy available, Medisquare reserves the right to suspend or terminate a User’s access to the Website and the Services with or without prior notice

  1. Such a User has violated the Agreement’s terms and conditions;
  2. a third party complains that your use of the Services violated any of its rights;
  3. Any information provided to Medisquare by a User cannot be verified or authenticated by Medisquare;
  4. Medisquare has good reason to believe that such User is engaging in any type of unlawful, fraudulent, or abusive activities;
  5. In its sole discretion, Medisquare thinks that a user’s conduct may expose them, other users, or Medisquare to legal liability or are inimical to the goals of the website.

6.2 The User is not permitted to re-register under the same account, a different account, or use the Website after being temporarily suspended, permanently suspended, or terminated. If an account is closed for one of the reasons listed here, the user will no longer have access to any data, messages, files, or other materials they have stored on the website. In order to adhere to the User’s record keeping method and practices, the User shall guarantee that he/she/it has ongoing backup of any medical services provided.

  1. Limitations of liability

In no event, including but not limited to negligence, shall Medisquare or any of its directors, officers, employees, agents or content or service providers be liable for any direct, indirect, special, incidental, consequential, exemplary or punitive damages arising out of, or in any way connected with, the use of, or the inability to use, the Website or the content, materials, and functions related thereto, the Services, or the User’s provision of information via the Webs. The Protected Entities are never responsible for:

  1. Provision of all services by Practitioners to End-Users contacted or managed through the Website, or failure to do so
  2. Any information shared, sent, exchanged, or received through the Website by or on behalf of any User or other person
  3. Any alterations to your transmissions or data that are made without your authorization
  4. Any other issue involving the service or the website
  1. Retention and Removal

Depending on the type of information, the purpose, the means, and the modes of utilization of such information, Medisquare may preserve such information collected from Users from its Website or Services for as long as necessary. Logs from computer web servers may be kept for as long as is administratively required.

  1. Applicable law and dispute settlement

You acknowledge and accept that the laws of Bangladesh shall govern this Agreement and any legal obligations Medisquare and User may have. Any dispute will be settled within the laws of Bangladesh.

  1. Contact Information Officer

  1.  Severability

The remainder of the Agreement shall be interpreted as if such provision were so excluded and shall be enforceable in accordance with its terms if any provision of the Agreement is determined by a court of competent jurisdiction or arbitral tribunal to be unenforceable under applicable law; provided, however, that in such event, the Agreement shall be interpreted so as to give effect, to the greatest extent possible, to the parties’ intentions as expressed in the provision that was found to be unenforceable.

  1. Registration

The user will provide correct information during the registration on the website of Medisquare. The team of Medisquare will not be held if there is any issue because of false information provided.

  1. Refund and cancellation

13.1 For other users:  

  1. Users can cancel a consultation if the wait time in line exceeds 60 minutes, and a refund will be issued after a processing fee of 5% is deducted.
  2. Users can seek a rescheduling of their appointment, but they must do so at least three hours prior to the planned time. There will be no additional charges as a result of this.

13.2 For practitioners:  In the case you want to cancel your subscription after payment: 

  1. If the cancellation is within 5 days you will be fully refunded. 
  2. If the cancellation is within 5-10 days you will be refunded 85% of your subscription fee. 
  3. However, no refunds will be provided after 10 days.
  4. You will be refunded by Medisquare in 5 business days. 
  1. Medisquare health plan- User terms and conditions

14.1 Nature and applicability of terms:

Before choosing to use the health plan service made available by Medisquare on its website, please carefully read these Medisquare Health Plan Terms. In connection with Your visit to the Website and Your use of the Health Plan Service, respectively, the Standard Policies and the Medisquare Health Plan Terms are to be read. The Medisquare Health Plan Terms hereunder shall take precedence over the Standard Policies to the extent that there is any discrepancy between them and the Standard Policies, if there is any.

Any person who subscribes to the Health Plan Service on behalf of or for the benefit of a patient, either separately or in conjunction with his or her family members or relatives, is subject to these Medisquare Health Plan Terms. The principal user must be signed up on the website and have purchased a Health Plan Service subscription. The primary subscriber to the Health Plan Service for the purposes of these Medisquare Health Plan Terms is the person designated as the primary user in the Plan Page (as defined below), who subscribes to the Health Plan Service either on an individual basis or for the benefit of other members, which may include any other person nominated by the Primary Member (hereinafter collectively referred to as the “Covered Members”).

Hereinafter, “You,” “Your,” “User,” and “Users” collectively and individually refer to the Covered Members and a Primary User. According to the plan specifics contained in your Medisquare application (“Plan Details”), you can select from a variety of packages available under the Health Plan Service that best suit Your needs. You will be able to see the user-specific information on the “Plan Page” of your paid plan, which is hosted on your Medisquare application.

By using the Health Plan Service, you agree to these Medisquare Health Plan Terms as well as the Standard Policies.

For any reason and at any time, we retain the right to change or eliminate any part of these Medisquare Health Plan Terms and the Standard Policies. Such changes will be communicated to You through the proper Website alerts. The Medisquare Health Plan Terms and the Standard Policies should be read frequently. You agree to abide by and be bound by these Terms and the Standard Policies as updated if you continue to use the Health Plan Service after any such changes.

You understand that if you use any of the Health Plan Services, you will be subject to the Medisquare Health Plan Terms. Please refrain from using the website or using the health plan service if you disagree with any element of these Medisquare Health Plan Terms and/or the Standard Policies.

Your usage of the Health Plan Service and access to it will be entirely up to Medisquare’s discretion.

14.2 Conditions of use:

In order to register on the website and use the Health Plan Service as a Primary User, you must be eighteen (18) years of age or older. With the express understanding that the Primary Member shall be entirely responsible and liable on all counts for compliance with these Medisquare Health Plan Terms for and on behalf of such Covered Member who is below the age of majority, You may add minors as Covered Member(s) under the Health Plan Service that You have availed of and subscribed to. You represent and warrant to Medisquare that You are eighteen (18) years of age or older and have the legal capacity to enter into a contract on behalf of a Covered Member who is under the age of majority. You also represent and warrant to Medisquare that You have the right, authority, and capacity to use the Website for availing the Health Plan Service and that You agree to and abide by the Terms and the Standard Policies.

14.3 Terms of the health plan service

14.3.1 Term: The Health Plan Service that You have subscribed to will be valid for the time frame specified in the Plan Details beginning on the date of Your subscription (“Term”). You may select a new plan and subscribe to it or renew your current subscription after the term has expired under the terms that are in effect on the date of subscription or renewal. After the Term has ended, the benefits under the Health Plan Service cannot be continued.

14.3.2 Registration: The Primary User has subscribed to the Health Plan Service on the Website by paying the appropriate payments in accordance with the Plan Details. The Primary User is a registered user on the Website. You could use the Plan both for yourself and any Covered Members or just for yourself (s). To use the Health Plan Service, each Covered Member who is covered by the Health Plan Service that You have subscribed will need to undergo an authentication process. The Plan Details will specify the maximum number of Covered Members that may be assigned to each Primary User. Once added by the Primary User, Covered Members cannot be deleted, changed, or altered.

14.3.3 Information: As part of the Health Plan Service registration procedure, You will enter certain personal information and specifics to build a medical history and profile that will be available to the Practitioners. The Standard Policies will be followed while handling the information that You share.

14.3.4 Details about the Health Plan Service: As a part of the Health Plan Service, You are entitled to the benefits (which may include such number of consultations, offers on medicines ordered through the Website, discounted health check-ups, discounts / offers on diagnostic tests, and Family Doctor benefit, or any other benefit that Medisquare may offer in the future) that are outlined in the Plan Details.

14.3.5 Process for the Health Plan Service: Following your purchase of the Health Plan Service, you will be qualified to get the following benefits:

Consultations: Utilization of Covered Consultations: You are entitled to a set number of subsidized consultations with Covered Practitioners as part of the Health Plan Service (“Covered Consultations”). The “Covered Practitioners” for the purposes of these Terms are the Practitioners that Medisquare has onboarded to offer You the Covered Consultation as a Health Plan Service. Under Your Plan Page, a list of the Covered Consultations for which you are qualified will be visible. You have two options for obtaining the Covered Consultations: booking through the Website using the Book facility (as described on the Website), or walking in. It is made clear that the Covered Consultations’ benefits would be determined cumulatively rather than per member.As an example, one primary user who has four covered members who are each eligible for a total of ten covered consultations has enrolled to the health plan service. This indicates that the total number of Covered Consultations for the Primary User and the Covered Members is 10. One individual user or more than one individual user may use the 10 covered consultations in any combination and amount they decide as a group. The Health Plan Service still allows you to receive other benefits even if you have used all of the covered consultations; however, if you still want to see a covered practitioner after using all of the covered consultations, you will need to pay the covered practitioner’s standard rate at their location. You may be able to extend your Health Plan Service only in order to add more Covered Consultations to your subscription during the Term if, prior to the end of the Term, you have used all of the Covered Consultations for which you were eligible.

14.3.6 Payment for the Health Plan Service: You must pay Medisquare the amounts specified in the Plan Details at the moment you subscribe to the Health Plan Service. You are not obliged to pay anything when you visit the practitioner’s office for a covered consultation as long as your eligibility for covered consultations is valid and has been specified in the plan page. You must inform the billing department of the Practitioner’s institution that you have used the Covered Consultation service as part of a Health Plan Service before the Practitioner’s establishment can validate your use of the service.

14.3.7 Cancellation and Refund Policy for Health Plan Services:

The option to end your subscription to the health plan services may be available to you. You can terminate your subscription to the Health Plan Service by contacting Medisquare via the customer service chat channel. Additionally, Medisquare may reimburse the sum that you paid for your subscription to the Health Plan Services.

14.3.8 You are eligible for a variety of savings opportunities, deals, and advantages as part of the Health Plan Service. It is made clear that none of these Health Plan Service benefits may be exchanged for cash.

14.4 The appropriate user terms under the Standard Policies must be reviewed in addition to and concurrently with the Medisquare Health Plan Terms included above. The Medisquare Health Plan Terms will take precedence over the Standard Policies to the extent of any contradiction between them.
